Terms of Service

1. Acceptance of terms

By accessing or using candymonium.com (the “Site”) or placing an order with Candymonium, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Site or place an order.

2. Products & custom orders

All products sold by Candymonium are custom-made to order. Because each item is produced specifically for the client based on an approved design, we do not accept returns or exchanges on completed custom orders except in the circumstances described in Section 6 (Damaged or defective products).

A custom order is confirmed when you have approved a digital proof and paid the required deposit. Work on your order begins only after both conditions are met. Changes to design, quantity, or specification after proof approval may not be possible and may incur additional cost.

3. Pricing & payment

All prices are quoted in US dollars and are subject to change until a written quote is confirmed. Quoted prices are valid for 30 days from the date of the quote unless otherwise stated.

We typically require a deposit before production begins, with the balance due on completion prior to shipment. Specific deposit and payment terms are set out in your project quote. Accepted payment methods are confirmed at the time of quoting. Overdue balances may delay shipment and accrue interest at the maximum rate permitted by applicable law.

4. Intellectual property

Your assets. By submitting logo files, artwork, or brand materials, you represent and warrant that you own or have the right to use those materials and that their use by Candymonium as directed by you does not infringe any third-party intellectual property rights. You indemnify Candymonium against any claims arising from our use of your submitted materials.

Our content. All content on the Site including text, images, design, and code is owned by or licensed to Candymonium and may not be reproduced without prior written permission.

5. Production timelines

Estimated production and shipping timelines are provided in good faith and are not guaranteed. Timelines begin from the date of proof approval, not from the date of enquiry, deposit, or order placement. We are not liable for delays caused by carrier disruption, acts of nature, or circumstances outside our reasonable control. If your order has a firm event date, please share that date at the quoting stage so we can assess feasibility before production begins.

6. Damaged or defective products

If your order arrives damaged or contains a manufacturing defect, please contact us within 48 hours of delivery with photographs of the affected items and the outer packaging. We will assess the situation and, at our discretion, arrange a replacement, credit, or refund for the affected items. Candymonium’s liability is limited to the value of the affected portion of your order.

We are not responsible for damage resulting from improper storage by the recipient, exposure to heat after delivery, or use of the product outside its intended purpose.

7. Food safety & allergens

Our products are made in a facility that handles milk, soy, tree nuts, and wheat. While we take care to prevent cross-contamination, we cannot guarantee that any product is entirely free from allergen traces. Buyers are responsible for communicating allergen requirements before placing an order, and for ensuring recipients are informed of potential allergens. Candymonium is not liable for allergic reactions resulting from failure to communicate known allergen requirements.

8. Limitation of liability

To the maximum extent permitted by law, Candymonium’s total liability to you for any claim arising from a product or order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages of any kind, including loss of business, loss of profit, or damage to reputation.

9. Governing law

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

10. Changes to these terms

We may update these Terms of Service at any time. When we do, we will revise the effective date at the top of the page. Continued use of the Site or placement of an order after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
